When a relationship breaks down and a shared property is involved, getting an accurate, independent valuation is important to ensure the fair division of assets. Whether the property is to be sold and the proceeds split, or one party is buying the other out, both sides need a figure they can rely on.

As a RICS registered valuer based in Southam, I provide independent matrimonial property valuations across Warwickshire, North Oxfordshire, and Northamptonshire. What is a Matrimonial Valuation?

A matrimonial valuation is a formal, independent assessment of a property's market value, carried out specifically for the purposes of divorce or separation proceedings. Unlike a standard property appraisal from an estate agent, it is an independent, evidence-based assessment to inform the financial settlement between the parties, and in many cases, it forms part of the documentation presented to a solicitor or the family court.

 

Because the valuation may be scrutinised by solicitors, barristers, or a judge, it needs to be prepared to a formal standard. I provide matrimonial valuations that follow RICS Red Book rules, which means they are prepared to the highest professional standards and carry the authority required in legal proceedings. An estate agent's property valuation is not the same thing. It is informal, not independently verified, and is unlikely to be accepted in court if either party chooses to challenge it.

When is a Matrimonial Valuation needed?


A formal property valuation is typically required when:

  • A jointly owned property is to be sold as part of a financial settlement and both parties need an agreed, independent value to divide the proceeds.

  • One party is buying out the other's share and the purchase price needs to be established fairly.

  • Solicitors are negotiating a financial settlement and require an independent valuation to form part of the evidence.

  • The case is proceeding to court and a formal RICS report is needed to support the financial disclosure.

  • There is a disagreement between the parties about the property value and an independent expert view is required to resolve it.

Acting as a Single Joint Expert (SJE)

Where both parties and their legal representatives agree, I can act as a single joint expert valuer. In this role, I am appointed jointly by both parties and my report is provided to both solicitors. I am impartial, I report the facts, and my valuation is not influenced by the instructions of either side.

 

This approach is often quicker and less expensive than each party commissioning a separate report, and it avoids the situation where two conflicting valuations need to be reconciled. It is worth discussing with your solicitor whether this is the right approach for your situation.

What the Valuation Involves

I inspect the property carefully, assessing its condition, size, layout, tenure, and any factors that affect its value on the market. I research local comparable sales and prepare a formal Red Book valuation report that sets out my methodology and conclusions clearly.

 

The report is written to be understood by property specialists and, fundamentally, the parties themselves. If there are aspects of the property that are likely to affect its marketability, whether that is a condition issue, a tenure complication, or something else, I will explain that clearly to avoid any ambiguity. I am also happy to discuss the valuation with solicitors directly if that is helpful.
